Election Update - Focusing on Pennsylvania
As the ballots continue to be counted in battleground states for the U.S. Presidency including Pennsylvania, I wanted to give you a state perspective as to what our legislative climate will be looking like in the next Pennsylvania Legislative Session (2021-2022).

As of 11/11/2020 at 3:00 PM:

Pennsylvania Attorney General

Attorney General Josh Shapiro (D-Incumbent) defeated Heather Heidelbaugh (R)

Pennsylvania Auditor General

Timothy Defoor (R) defeated Nilofer Nina Ahmad (D) – open seat

Pennsylvania Treasurer

Stacy Garrity (R) defeated Treasurer Joseph Torsella (D-Incumbent)

Pennsylvania Senate – Republican net +1 – Republican Majority:

DEP Revises Three Forms
The Department has revised three forms. These include the small noncoal application, the bond summary form and the bond release forms. They have posted the new versions of these on their website.

DEP Electronic Submittal of Discharge Monitoring Reports for Mining
The Department is strongly encouraging you to begin submitting your Discharge Monitoring Reports electronically, if you have not already done so. You will need a DEP Greenport account. We encourage you to do this now.

DEP Goes Electronic on Production Report
The Department is in the process of converting paper reporting of the annual Mine Employment and Production Report to electronic reporting. Completion of this transition is the end of 2020. Your reports from 2019 production are due January 21, 2021.

To help you with this transition, DEP will be holding a series of two webinars—one on November 19 that covers an overview of the project and one on January 7 that covers training for submittals. It is our recommendation that you view both of these. You will need a DEP Greenport account before you can submit electronically.

DEP Engineering Manual Available for Public Comment
The Engineering Manual proposed draft has been published in the PA Bulletin and the Department is accepting public comments through January 28, 2021.

We will be coordinating with the PA Coal Alliance to ensure all comments are coordinated. Thanks again to those of you who assisted with the review of the previous draft. Your help is very much appreciated.

PA DEP Chapter 77 Revisions
25 PA Code Chapter 77 is the regulation that implements the noncoal mining program statute. PACA has been working with the Department on corrections and clarifications to the program.

The entire proposed rulemaking package for Ch. 77 is on the agenda of the Environmental Quality Board’s November 17th meeting. The Department is recommending adoption of this proposed rulemaking with a 45-day public comment period and no public hearings.

We anticipate the EQB will vote to move forward with the proposed rulemaking. The next step would then be publishing of the proposed rulemaking in the PA Bulletin for public comment.

As information only, also on the agenda is the proposed rulemaking for Water Supply Replacement for Surface Coal Mining.

Don't Forget to Register for Monday & Tuesday's Virtual Annual Meeting Sessions
As the meeting/event planner for PACA for two decades, I must say this year has been the most stressful. While there are no badges to be printed, packets to be organized, onsite logistics to be organized, schedules to be printed, there are still many details to be handled relating to a virtual Annual Meeting. But, absolutely, the worst detail and the most stressful to me, is not getting to see everyone in person! However, with all that being said, I still hope that you will join us and that you find our 38th [virtual] Annual Meeting to be as successful as it can be during these unprecedented times.

Just a few reminders and notes regarding the two-day virtual Annual Meeting:

1. Day one - Monday, November 16th - features keynote speaker Anirban Basu, PACA's very favorite economist, presenting Back to the Future, A Tribute to 80's Movies, relating this back to the economy as only Mr. Basu can. His presentation begins at 2:00 PM.

2. Day two - Tuesday, November 17th - features Governor Wolf's Chief of Staff, Mike Brunelle. Submit your questions in advance to me at [email protected]. Mike's presentation begins at 11:00 AM.

3. Tuesday's presentation also includes our Board of Directors and Associate Board of Directors elections. We encourage all to participate and cast your vote - no recounting necessary here! Also, we will celebrate the accomplishments of our outgoing Chairman of the Board, Rod Martin, Martin Stone Quarries, and welcome our incoming Chair, Bob Housel, Masters RMC, Inc.
